A sound in violation is determined to be excessive noise (disturbs the peace or injurious to health, or interferes with enjoyment of home, work, entertainment) when the sound is plainly audible (clearly heard or understood) to a person of normal hearing when distances and/or times specified are not met.

· On private property, measured at the property boundary of the noise source or at any point within any other property affected by the noise
· On multi-unit property, measured from common areas within or outside the structure or from other dwelling units within a structure
· On public property or sidewalks, measured at least 100 feet from the noise source

· Residential area - Daytime: 65 dBA (Nighttime: 55 dBA)
· Commercial area - Daytime: 67 dBA (Nighttime: 62 dBA)
· Industrial area - Daytime: 75 dBA (Nighttime: 75 dBA)

· Daytime Weekday Hours - 7:00am to 10:00pm
· Daytime Weekend Hours - 9:00am to 11:00pm (includes City Scheduled Holidays)
Þ Construction noise hours - start at 7:00am weekdays and Saturday, 9:00am on Sundays
Þ Construction noise hours - start at 6:00am during Summer (June 20-Sept. 22) M-F & Sat, 9:00am on Sundays

There are 14 exemptions from the noise ordinance which includes, but not limited to, trains, HVAC equipment, school activities, athletic events, lawn care equipment during daytime hours, construction work during approved hours, church bells, parades, and fireworks.
