Adequate Public Facilities Ordinance

The Mayor and City Council of Hagerstown adopted an Adequate Public Facilities Ordinance for schools on April 25, 2006. The APFO goes into affect on May 25, 2006. Any final plats, preliminary plats, or site plans approved in the City prior to May 25, 2006 are exempt from the APFO. Once the APFO is in effect, no preliminary plat or site plan within the City shall be approved unless the schools have adequate capacity or the developer has received approval for a mitigation program to address the school issue. Certain exemptions are outlined in the APFO.
