Licensing Overview The Rental Licensing Program, created and implemented in 2003, has dramatically increased the City of Hagerstown’s ability to not only respond but to also be proactive in identifying unsafe property maintenance conditions and ensuring compliance with City Code. Components What are the components of the Rental Licensing Program? There are three components of the Rental Licensing Program:
Registration What qualifies as a rental property under the Rental Licensing Program? A structure located in the City containing one or more dwelling units which are rented, leased or let by the owner to tenants for occupancy as a residence.Are there any rental properties that are exempt from this program? Yes: Newly constructed properties, for the one year period immediately following the issuance of the use and occupancy permit, where any portion of the premises is owner-occupied and said premises contains no more than one rental unit, and a rental facility owned and operated by the Housing Authority of the City of Hagerstown.Buying/Selling I am buying a property that is currently registered with the City. What do I need to do to be in compliance with the Rental Licensing Program? A: The license for the property will transfer to you at the sale of the property, but after the sale goes through, you do need to call the Office of Code Compliance (OCC) and supply us with your contact information.Q: Can I sell a registered rental property that has outstanding violations? A: Yes. By law you must inform the prospective buyer of the violations, as the new owner will be responsible for bringing the property into code compliance. Inspections When does a rental unit need to have an interior inspection? It is mandatory that each rental unit not yet inspected under the rental licensing program be inspected at the next tenant turnover. The property owner is responsible for calling the OCC to schedule the interior inspection at least 3 full business days before the new tenant is scheduled to move into the unit. Once the unit is inspected, the inspection is valid for three years, regardless of how many tenant turnovers occur at that unit.Do I need to call to schedule my rental property’s annual exterior inspection? No, you do not need to call to schedule the annual exterior inspection. You will receive a completed exterior checklist in the mail. The inspector’s name and telephone extension will be on the checklist, and you should call them if you have any questions or concerns.My rental unit is inspected under the section 8 program. Do I still need to have it inspected under the Rental Licensing Program? Yes. The Section 8 program and the City’s Rental Licensing Program are different programs with different inspections.Schedule an Interior Inspection |
